  • Nowadays, everyone has the use of technological tools and the internet to exchange information. It is a borderless society where the internet and social media are regarded as having an important role in people's lives. On the other hand, these are like weaponsthat can be used to stab or hurt other people who are judged by society thisproblem leads to problems that cause nuisance and, in some cases, have seriouslife-threatening consequences. This problem is commonly known as Cyberbullying.

    What is Cyberbullying?

    “Cyberbully” is the practice of bullying, harassing, or bullying others using digital devices.This can happen through social media. Texting, Gaming, and Cell Phones.Cyberbullying is a series of repetitive behaviors aimed at frightening,infuriating, or humiliating the target. This is regarded as a form of privacy violation that can often be seen nowadays.

    Online bullying canoccur in many ways, from victimizing others to causing physical harm to the victim. use negative language Cursing, mocking, slandering, threatening,discriminating against gender and ethnicity through conversation channels, orreviling through social media posting.

    This includes Impersonating someone else in order to slander them. or editing images that areexaggerated in illegal ways Even secretly taking pictures and sharing themonline, assuming sexual harassment It is a profit action that is frequently carried out by attacking the opponent.

    The effect of Cyberbullying

    Online harassment canaffect victims of all ages. Which can cause such as embarrassment, fear,paranoia, depression, feelings of loneliness, sadness, discouragement,hopelessness, and worthlessness, as well as physical health effects such asinsomnia, chronic fatigue, illness, self-harm, and even suicide attempts.

     

    Cyberbullying andHuman Rights

    According to the Universal Declaration of Human Rights (UDHR), countriesagree that rights and freedoms must be protected so that human beings can live freely, equally and with dignity. Which will be noticed that the action called Cyberbullying or online bullying It is an act that is contrary to the Universal Declaration of Human Rights. Especially in Article 29, which is aboutrespecting the rights of others.

    Article 29

    (1) Everyone has dutiesto the community in which alone the free and full development of hispersonality is possible.

    (2) In the exercise ofhis rights and freedoms, everyone shall be subject only to such limitations asare determined by law solely for the purpose of securing due recognition andrespect for the rights and freedoms of others and of meeting the justrequirements of morality, public order and the general welfare in a democraticsociety.

    (3) These rights and freedoms may in no case be exercised contrary to the purposes and principles ofthe United Nations.

    Legal Consequences of Cyberbullying

                Bullying and insulting others on social media are unacceptable. These are typical cyberbullying behaviors. which has a negative impact on and hurts the victim which is sometimes an act that is too extreme, to the point of being unethical and illegal.

    If it can identify who the victims are. Even if the name is not mentioned, it may be illegal. Forexample, defamation offenses under the Criminal Code

    Section 226 Whoever,by any means whatever, to render a building, dock, public parking or mooringplace for cars or vessel, buoy, structure, machinery, mechanical apparatus,electric wire or an equipment provided for the protection of persons or thingsfrom danger so as likely to cause danger to the other person, shall be punishedwith imprisonment not exceeding five years or fined not exceeding ten thousand Baht, or both.

    Section 228 Whoever,by any means whatever, cause inundation or obstruction to the supply of water,which is a public utility, and if such act is likely to endanger the otherperson or a thing belonging to the other person, shall be punished with imprisonment not exceeding five years or fined not exceeding ten thousand Baht,or both.

    If the commission ofthe offence as mentioned in the first paragraph causes danger to the otherperson or a thing belonging to the other person, the offender shall be punished with imprisonment of six months to seven years and fined of one thousand  to fourteen thousand Baht.

    From the aforementioned provisions, it can be seen that there is a penalty of imprisonment of not more than 1 year, a fine of not more than 20,000 baht, or both. which is apersonal offense The victim must file a complaint with the investigator in order to prosecute the perpetrators.

    Although everyone has the right and freedom of expression, that freedom must be exercised in respect of the law and not infringe on the rights of anyone. Cyberbullying is a violation of human rights and a type of crime thatcan negatively affect someone mentally, emotionally, or physically, and inextreme cases can lead to the victim's suicide in the end.

    As a result, we must join together to campaign to stop cyberbullying. Because no one deserves to be threatened, and everyone deserves to be respected fortheir individual rights. whether in the real or virtual worlds.
